1. Introduction
Welcome to Dulce Bembé ("we," "us," "our," or "the Business"). These Terms & Conditions ("Terms") govern your use of our website and the purchase of products from Dulce Bembé, a Cottage Food operation based in Central Florida.
By placing an order with us, you agree to be bound by these Terms. If you do not agree, please do not place an order.
2. Cottage Food Operation Disclaimer
Dulce Bembé operates under the Florida Cottage Food Law (Section 500.80, Florida Statutes) . All products are prepared in a home kitchen that is not subject to state food safety regulations or inspections.
By purchasing from us, you acknowledge and agree that:

3. Product Information & Ingredients
All desserts are made with almond flour, coconut flour, and allulose unless otherwise stated.
Important disclosures:
Full ingredient lists and common allergens (eggs, nuts, milk, coconut) are provided with each dessert
All products are made with gluten-free ingredients and no added sugar
We do not conduct laboratory testing; therefore, we do not use FDA-regulated "Gluten-Free" or "Sugar-Free" seals
Product descriptions and images are for illustration purposes and may vary slightly
4. Order Confirmation & Deposit
50% Deposit Required
A 50% non-refundable deposit is required to confirm your order
This deposit secures your production slot and covers ingredient costs
Your order is not confirmed until the deposit is received
Exceptions:
Orders under $20 may require full payment upfront
Urgent orders (less than 48 hours notice) may require full payment depending on availability
Full payment is required before delivery or pickup.
5. Payment Methods

Payment details are provided after your order is confirmed.
By using these third-party payment platforms, you agree to their respective terms of service. We do not store your payment information.
6. Cancellations, Refunds & Returns
No Refunds; Final Sale
All sales are final. We do not offer refunds or returns.
However: If there is an issue with your order (e.g., damaged during delivery, incorrect item), please contact us within 24 hours of receiving your order. We will make every reasonable effort to make it right, which may include a replacement or credit toward a future order.
Cancellations:
Cancellations made more than 72 hours before your scheduled pickup/delivery may receive a refund of amounts paid beyond the 50% deposit (deposit remains non-refundable)
Cancellations within 72 hours of pickup/delivery are not eligible for any refund
7. Delivery & Pickup
Local Pickup
Pickup is by appointment only in Altamonte Springs and nearby areas
You will receive pickup instructions after your order is confirmed
Local Delivery
Delivery is available in certain areas for an additional fee
Delivery fees are disclosed before you confirm your order
We are not responsible for delays caused by weather, traffic, or other circumstances beyond our control
Rescheduling:
If you need to reschedule, you must communicate with us no less than 24 hours before your scheduled pickup time
Rescheduling requests made less than 24 hours before pickup may not be accommodated
No refund will be issued if we cannot accommodate a late rescheduling request
Abandoned Orders:
If you do not pick up your order at the scheduled time and/or have not communicated a rescheduling request, your order will be considered abandoned
No refund will be issued for abandoned orders
Abandoned orders will not be held for future pickup
No Shipping
We do not currently offer shipping

8. Ingredient & Allergen Disclaimer
Our products may contain or come into contact with common allergens, including:
Eggs
Nuts
Milk
Coconut
You assume all risk related to food allergies or sensitivities. If you have a severe allergy, please contact us before ordering to discuss whether our products are safe for you.
We do not guarantee that our products are free from cross-contamination with any allergen.
9. Storage & Shelf Life
Desserts can be enjoyed at room temperature
Shelf life is 5 to 7 days when stored properly
Products can be frozen for longer storage
We are not responsible for product quality after delivery or pickup. Please follow storage instructions.
10. Limitation of Liability
To the maximum extent permitted by Florida law:
Our total liability to you for any claim arising from your order or use of our products shall not exceed the amount you paid us for the product giving rise to the claim
We are not liable for any indirect, incidental, or consequential damages (including but not limited to allergic reactions, medical expenses, lost time, or lost profits)
This limitation applies even if we were advised of the possibility of such damages.
11. Dispute Resolution
Informal Resolution First
Before bringing any legal claim, you agree to first attempt to resolve the dispute informally by contacting us at dulcebembe@gmail.com. We will attempt to resolve the dispute within 30 days.
Small Claims Court
If the dispute cannot be resolved informally within 30 days, either party may bring a claim in the Small Claims Court of Florida in the county where the transaction occurred.
No Arbitration
Both parties agree to resolve disputes in Small Claims Court rather than arbitration.
Time Limit to Bring a Claim
Any claim arising from your order must be brought within one (1) year from the date of the transaction. Claims brought after one year are barred.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.
12. Eligibility
By placing an order with Dulce Bembé, you confirm that you are at least 18 years of age. If you are under 18, a parent or legal guardian must place the order on your behalf.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by an updated "Last Updated" date. You are responsible for reviewing these Terms periodically.
Continued use of our services after changes constitutes your acceptance of the updated Terms.
